An appeal was filed before the Financial Commissioner, Delhi under section - 8(3) of the Delhi Nursing Homes Registration Act, 1953 by Max Healthcare Institute Limited against the order of cancellation of its license by the Directorate General of Health Services, GNCTD.

It may be noted that the powers of appellate authority under various Acts including the Delhi Nursing Homes Registration Act, 1953 have been delegated to the Financial Commissioner, Delhi, by an Act of Delhi Legislative Assembly named the Delhi (Delegation of Powers ) (Amendment)  Act, 1994.

The powers of appellate authority, being a quasi judicial function are performed by the Financial Commissioner, Delhi as per his/her judgment without any interference or supervision by any authority.

It may also be noted that the orders of the Financial Commissioner, Delhi can be challenged by an aggrieved person/entity, if any, before the Hon’ble High Court of Delhi under its writ jurisdiction. It appears that a misinformation campaign was launched by vested interests, whereas the office of Lt. Governor at no stage is/was involved in this matter.
