Major steps taken for implementation of PM-UDAY (PM -unauthorized Colonies in Delhi Awas Adhikar Yojna) conferring/recognising ownership rights to the residents of unauthorized colonies.

Lt. Governor directs for withdrawal of cases under section 81 of the Delhi Land Reform Act in cases of unauthorized colonies.

Hon’ble LG approves urbanization of 79 villages to facilitate conferring/recognising ownership rights to the residents of unauthorized colonies.  

A Step closer to fulfill  dreams of residents living in unauthorized colonies  as per PM-UDAY: LG

Today Honble Lt. Governor has approved major steps for conferring/recognizing ownership rights for the residents of unauthorized colonies under the PM-UDAY (PM-unauthorized Colonies in Delhi Awas Adhikar Yojna). Honble Lt Governor approved :

  1. Withdrawal of cases under section 81 of the Delhi Land Reform Act.
  2. Urbanization of 79 villages under section 507 of DMC Act 1957.

Hon’ble Lt. Governor of Delhi, Sh. Anil Baijal directed withdrawal of cases instituted under section 81 of the Delhi Land Reform Act, 1954 in respect of private lands falling within the boundaries of Unauthorised Colonies, specified in Regulations, 2019 notified by the Central Government, as a first step towards conferment/recognition of ownership rights to the inhabitants of unauthorized colonies.

Hon’ble LG also approved the urbanization of 79 rural villages under section 507 of DMC Act 1957 where the unauthorized colonies are located to take them out of the ambit of Delhi Land Reforms act which imposes several restrictions on land use.

Further, by virtue of declaring rural villages as urban under Section 507, the DDA will be able to frame development plan to enable local bodies to provide civic and community facilities in the Unauthorized Colonies which would lead to a faster development in such colonies.

Under section 81 of the Delhi Land Reforms Act, 1954, proceedings are instituted for using private agricultural lands for purposes other than agriculture, horticulture, etc. in rural areas. Inhabitants who have utilized their private agriculture land for housing purpose are affected by this provision. As most of these unauthorized colonies exist on such private lands, this step will prove to be a major decision.

This decision is set to trigger planned development in the unauthorised colonies and facilitate residents of these colonies to possess clear property titles, access to basic amenities, access to loan or mortgage, incentivized area improvement/ redevelopment through liberalized development control norms. Clear title will also prevent fraud/forgery by introducing formal processes of property transfer and registration of titles.

This is in pursuance of the decision taken by the Union Cabinet under PM-UDAY (PM-unauthorized Colonies in Delhi Awas Adhikar Yojna) to recognize/confer ownership rights of the inhabitants of unauthorized colonies and notified NCT of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) Regulations, 2019 for this purpose. 

Hon’ble Lt. Governor stated that these steps will ensure smooth transition of title of properties to inhabitants of these Unauthorized Colonies and faster development in accordance with the PM-UDAY.
