In view of the reports appearing in the media, it is clarified that Hon’ble LG Had concurred with the recommendations of Sentence Review Board on 21.05.2020 as approved by Hon’ble Minister(Home), GNCTD to release 19 prisoners including Siddhartha Vashishta @ Manu Sharma as covered under the guidelines, provisions of CrPC and extant Prison Rules.
 
The facts of the case  are that Siddhartha Vashishtha S/o Sh. Vinod Sharma was undergoing life imprisonment in case FIR No. 287/1999, U/S 302/201/120B IPC& 27 Arms Act, P.S. Mehrauli, Delhi. The convict had undergone imprisonment of 16 years, 11 months and 24 days in actual and 23 years, 04 months and 22 days with remission. 
 
The case was evaluated by Sentence Review Board (SRB) as per Guidelines dated 16.07.2004 and Delhi Prison Rules, 2018. The Board is chaired by Minister (Home) GNCTD, with ACS (Home), Pr Secretary (Law), Addl District and Sessions Judge, Delhi , Chief Probation officer, Special CP (Crime) as Members and  DG, Prisons as Member Secretary. The Board  recommended for  release of the convict - Siddhartha Vashishtha in the meeting  without any disagreement.  
 
 The SRB Guidelines in the matter state that the every convicted Prisoner  undergoing sentence of imprisonment shall be eligible for consideration for premature release from prison after serving 14 years of actual imprisonment for consideration.  It is, however, stated in the guidelines that Total period of incarceration including remission in these cases shall ordinarily not exceed 20 years.
 
It is relevant to state that Hon’ble High Court of Delhi in WP (Crl) 190/2019 in its judgment dated 21.01.2019 in the matter of Siddharth Vashistha vs NCT of Delhi had held that “ In the circumstances, it is expected that the sentence Review Board shall consider this petition in its entirety along with the judgment of this court in Sushil Sharma (supra) in its next meeting, which is to be held in March 2019 or thereabouts.” . It is further noteworthy that Hon’ble High Court of Delhi in WP (Crl) 3798/2019 in judgment dated 21.12.2018 in the matter of Sushil Sharma vs NCT of Delhi had held that “50. In view of the foregoing, in order to justifiably continue the incarceration of Sushil Kumar Sharma, beyond the maximum period stipulated in the guidelines, it is incumbent upon the State to provide cogent and compelling reasons for his further detention.” 

Therefore, keeping in mind the recommendations of the board, guidelines, rules and court orders in the matter, Hon’ble LG concurred with the recommendations of Sentence Review Board for release of 19 life convicts including Siddhartha Vashistha @ Manu Sharma as approved by Hon’ble Minister(Home), GNCTD. The decision was communicated by Home Department to Prisons on 25.05.2020 and Siddharth Vashistha @ Manu Sharma was released from prison on 01.06.2020.
